Abstract

RESUMEN: En la presente monografía, se identifica la excepcionalidad jurisprudencial de la Corte, sobre el debate entre el derecho al trabajo de los vendedores informales y el derecho al espacio público, situación que abre un nuevo campo de análisis, teniendo en cuenta que el Alto Tribunal, reconoce la primacía del trabajo informal, de modo excepcional, desde el reconocimiento de sujetos de especial protección, además como sostiene la Corte, ningún derecho es absoluto, sin embargo, en contextos de marginalidad económica y otras condiciones especiales, se ampara excepcionalmente un derecho individual, que es el derecho al trabajo de los venteros informales. (Corte Constitucional , 2024, p.22). ABSTRACT: In this monograph, the jurisprudential exceptionality of the Court is identified, on the debate between the right to work of informal vendors and the right to public space, a situation that opens a new field of analysis, taking into account that the High Court, recognizes the primacy of informal work, in an exceptional way, from the recognition of subjects of special protection, in addition, as the Court maintains, no right is absolute, however, in contexts of economic marginality and other special conditions, an individual right is exceptionally protected. . , which is the right to work of informal vendors.
