dc.description.abstractEl cómputo del término prescriptivo de la acción de prevalencia adelantada por uno de los partícipes del acuerdo simulatorio ha suscitado un debate jurisprudencial que ha sido demarcado en los últimos años, por lo que este trabajo de investigación se centrará en determinar, por medio de una línea jurisprudencial, la tendencia decisional de la Corte Suprema de Justicia respecto al tema, determinando los polos de respuesta, la última sentencia respecto al tema, realizando ingeniería de reversa graficando las sentencias citadas para identificar puntos nodales en la jurisprudencia y analizando las sentencias importantes tomando como índices de búsqueda los años 1955 a 2023.es_Es
dc.description.abstractABSTRACT: The calculation of the prescription term for the prevalence action initiated by one of the participants in the simulated agreement has sparked a jurisprudential debate in recent years. Therefore, this research aims to determine, through a jurisprudential analysis, the decisional trend of the Supreme Court of Justice regarding this matter, identifying the poles of response, the latest judgment on the subject, conducting reverse engineering by graphing the cited judgments to identify pivotal points in jurisprudence, and analyzing significant judgments using the years 1955 to 2023 as search indices.es_Es
